Can Owlet Medical process your personal data?
In accordance with the Law No. 6698 on the Protection of Personal Data (“KVKK”), Owlet Medikal processes certain data of yours in order to provide the services we offer you. As stated in Article 3/i of the KVKK; i. we have certain responsibilities and obligations as the “data controller” under the KVKK because we determine the purposes and means of processing personal data, and we are responsible for the establishment and management of the data recording system. As the data controller, we can process your personal data lawfully and respectfully of your personal rights if (i) you have given your explicit consent or (ii) the exceptions specified in Article 5/2 of the KVKK exist.
What data of yours does Owlet Medical process?
Through https://www.owletmedikal.com/, Owlet Medikal's mobile applications, mobile sites, Owlet Medikal stores, Owlet Medikal Special Customer Program Agreement, and other channels, we process your personal information (name/surname, date of birth, Turkish National Identity Number), mobile and landline phone numbers, email addresses, residential addresses, website traffic information (if you use our website), shopping history and payment methods, marketing and communication preferences, information on your social media accounts (if you link your membership with your social media accounts) and information regarding your purchases, in accordance with the Personal Data Protection Law (KVKK).
For what purposes do we process your personal data?

With whom does Owlet Medical share your data?
In order to provide the service given to our valued customers/users/members within the scope of the KVKK (Personal Data Protection Law) at the highest standards, your personal data may be transferred to our employees acting as representatives of the data controller within Owlet Medikal, to our domestic and foreign business partners with whom we have entered into contractual relationships to fulfill our obligations specified under the KVKK, to the real/legal persons from whom we receive services, to domestic and foreign organizations with whom we are program partners, to other third parties not listed in this clause but involved in data processing activities, and to administrative or judicial institutions/organizations authorized according to the laws of the Republic of Turkey.
What are Owlet Medical's responsibilities regarding the protection of your personal data?
As the data controller, we have certain obligations under the Personal Data Protection Law (KVKK) and other relevant legislation regarding the processing of your personal data. These obligations can be summarized as follows: Obligation to inform, Obligation to provide information, Obligation to ensure data security, and Obligation to register with the Data Controllers Registry.
a) Our Obligation to Provide Information
When collecting your personal data, Owlet Medikal is obligated to inform you, the data subjects, about: the identity of our representative within Owlet Medikal, the purpose for which your personal data will be processed, to whom and for what purpose your processed personal data may be transferred, the method and legal basis for collecting personal data, and your other rights listed in the KVKK (Personal Data Protection Law).
b) Obligation to Inform
If you request information regarding your personal data, you can exercise this right within the scope of the rights specified in question 6 of this document. If your request meets the conditions specified in the KVKK (Personal Data Protection Law), you will receive a response as soon as possible, and at the latest within 30 (thirty) days.
c) Obligation to Ensure Data Security
At Owlet Medikal, we make every effort to ensure that your personal data is processed lawfully and with respect for human rights, that it does not fall into the hands of unauthorized persons, and that it is protected according to the standards specified in the Personal Data Protection Law (KVKK) and other international texts. In this context, we: provide KVKK compliance training to our employees; create written policies regarding internal and external data processing activities; create a data inventory to make the data processing process as understandable and secure as possible; ensure that contracts signed with third parties comply with the KVKK and other relevant legislation; and conduct extensive work to improve our information technology infrastructure to provide the most secure infrastructure against cyberattacks.
d) Obligation to Register in the Data Controllers Registry (“Registry”)
As of the publication date of this Policy, there is no regulation published by the Personal Data Protection Board ("Board") regarding registration with the Registry, however, the process is being closely monitored by our expert legal counsel. We would like to inform our valued customers/users/members that we are developing our policies in accordance with the steps to be taken by the Board.
What are your rights regarding your personal data?
If you know or believe that your personal data is being processed by us, you can submit your request to us via application. The request will be submitted by data subjects as follows:
a) To find out whether your personal data is being processed,
b) Requesting information regarding the processing of your personal data,
c) To learn the purpose for which your personal data is processed and whether it is being used appropriately for that purpose,
c) To learn the third parties to whom your personal data is transferred, whether domestically or internationally.
d) Requesting the correction of your personal data if it has been processed incompletely or inaccurately.
e) Requesting the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK (Law on Protection of Personal Data).
f) Requesting that the actions taken pursuant to clauses (d) and (e) be notified to third parties to whom your personal data has been transferred.
g) The right to object to a result that is detrimental to you, if the analysis of your processed data is carried out exclusively by automated systems.
g) You have the right to claim compensation for damages if you suffer harm as a result of the unlawful processing of your personal data.
How long do we store your personal data at Owlet Medical?
Because personal data protection law requires a separate assessment for the processing of each type of data, we process your personal data lawfully and for the legitimate period necessary for its processing. In this context, we keep your personal data accurate and up-to-date as long as you have a valid legal relationship with Owlet Medikal. If your explicit consent for the processing of your personal data ceases, we continue to process your personal data within the periods specified in other legislation and/or within the principles stated in Articles 4 and 5 of the KVKK (Personal Data Protection Law). Following the cessation of the legitimate purpose and legal periods, your personal data is immediately deleted/destroyed/anonymized. Cookies: A cookie is a file left on your computer by any website.
